The items below describe the agreement between you and that entity (“Sodivone“) that sets out the terms and conditions (the “Terms“) by which you are offered access to enjoy its Services, whether on its own website and mobile applications (collectively “the Website“) or not.

These Services (“Sodivone Services”, “our Services“) refer to the following abilities; Viewing, purchasing, downloading, or distributing art created by its artists, participating in community activities (commenting, poll voting) on the Website, and any possible activity available on the Website.

Before using the Website, please read these Terms carefully and pay particular attention to these items:

You’ll need a Sodivone account to access some of our Services. To create an account and to use our Services, you must be an adult. You are responsible for all use of the account and all purchases made on the account. You may not, on behalf of another person or legal entity, use or create an account or use our Services for any commercial purpose. You recognise that all art created on this website are works of fiction.

You may sign up using your email address. We may also use your email address for sending newsletters and updates, as we explain in the privacy policy. We may send you an email to verify your ownership of the account.

Your use of our Services creates a legally binding agreement by and between you and Sodivone. You acknowledge that these Terms are entered into by and between Sodivone and you ⎯ and not with any third party distributor or operator of any platform through which you obtain or access our Services.

The Website (including, without limitation, software, code, files, images, contained in or generated by the software, accompanying data, and other embedded software) and changes and updates to the Website, are licensed to you by Sodivone for your own personal, non-commercial use, subject to the following: Neither title nor any intellectual property rights are transferred to you, but rather remain with Sodivone, who owns the full and complete title, and Sodivone reserves all rights not expressly granted to you.

You will not use any materials obtained from our Services to enter or upload any information into A.I. image generating software for either personal or commercial use without first obtaining permission from the title owner of such materials.

Your rights under this agreement will terminate automatically without notice from Sodivone if you fail to comply with any of the terms of this agreement. Upon the termination of this agreement, you shall cease all use of our Services.

When you purchase a digital product or subscription, the price will be made clear during the order process. You agree to pay the price that is stated at the time of your order, as well as any applicable taxes. You also agree to the billing frequency stated at the time of your order.

All digital purchases are final and no refunds will be given unless you reside in a country where applicable laws provides for a period of cancellation if you change your mind after a purchase. Sodivone will issue a full refund if requested within the statutory period, but only if you have not used, downloaded, or captured the product.

Donations can be refunded from up to a month since they were made.

Refunds apply only towards fiat currencies. Any purchases, subscriptions or donations made using cryptocurrency cannot be refunded.

Sodivone does not accept or consider creative ideas, suggestions or materials other than those Sodivone has specifically requested. This is to avoid the possibility of future misunderstandings when projects independently developed by Sodivone or its agents might seem to others to be similar to their own creative ideas, suggestions or materials.

If you do send us or post any unsolicited creative materials, including creative suggestions, ideas, notes, drawings, concepts or other information or if you transmit to the Website by electronic mail or otherwise, communications including any data, questions, comments, suggestions, or the like (collectively, the “Information”), the Information shall be deemed to be, and shall remain, the property of Sodivone. None of the Information shall be subject to any obligation of confidence on the part of Sodivone, and Sodivone shall not be liable for any use or disclosure of any Information.

You hereby assign to Sodivone all right, title and interest in and to the Information, including all intellectual property rights now known or hereafter existing throughout the universe, and Sodivone shall be entitled to unrestricted use of the Information for any purpose whatsoever, commercial or otherwise, without compensation to the provider of the Information.

While using our Services, you must comply with all laws, rules and regulations in the jurisdiction in which you reside. You must also comply with the behavioural rules listed below (the “User Rules”).

The User Rules set out in this Section are not meant to be exhaustive, and we reserve the right to modify them, as well as take appropriate disciplinary measures including comment deletion, account muting, account suspension or account termination to protect the integrity and spirit of our Services, regardless of whether a specific behaviour is listed in the User Rules or not.

The following are examples of behaviour that warrant disciplinary measures:

1. Impersonating any person, business or entity, including an employee of Sodivone, or communicating in any way that makes it appear like the communication originates from Sodivone;
2. Publicly posting identifying info about yourself, Sodivone employees, or other users;
3. Harassing, stalking or threatening other users or Sodivone employees;
4. Removing, altering or concealing any copyright, trademark, patent or other proprietary rights notice of Sodivone contained within our Services. You also may not transmit content that violates or infringes the rights of others, including patent, trademark, trade secret, copyright, publicity, or privacy rights;
5. Placing imagery in your profile picture which we deem to be divisive, provocative, or inappropriate;
6. Transmitting or communicating any content which we reasonably believe to be abusive to users, including language that is threatening, defamatory, and ethically or otherwise, objectionable;
7. Transmitting or facilitating the transmission of any content that contains a virus, corrupted data, trojan horse, bot keystroke logger, worm, time bomb, cancelbot or other computer programming routines that are intended to and/or actually damage, detrimentally interfere with, surreptitiously intercept or mine, scrape or expropriate any system, data or personal info;
8. Avoiding, bypassing, removing, deactivating, impairing, descrambling or otherwise circumventing any technological measure implemented by Sodivone or any third party to protect or control access to our Services or any part thereof;
9. Spamming the comment section, whether for personal or commercial purposes, by disrupting the flow of conversation with repeated postings;
10. Participating in any action which we reasonably believe does or may defraud any other user, including by scamming or social engineering;
11. Using any unauthorized third party programs, including mods, hacks, cheats, scripts, bots, trainers and automation programs that interact with our Services in any way, for any purpose, including any unauthorized third party programs that intercept, emulate, or redirect any communication relating to our Services and any unauthorized third party programs that collect info about our Services by reading areas of memory used by our Services to store info;
12. Accessing or attempting to access areas of our Services that are not made available to the public;
13. Inducing or encouraging others to breach the User Rules or these Terms; or
14. Using our Services for any business purpose without our express written consent or after we’ve asked you to stop using our Services.

We may mute, suspend, or terminate your account without notice to you if we reasonably determine, that:

1. you have breached any part of these Terms (including the User Rules);
2. doing so would be in the best interests of other users or our Services, or is required for upholding a third party’s rights;
3. you have (or we have reasonable grounds for suspecting that you have) made unauthorized use of someone else’s payment info.

These Terms shall remain effective until terminated in accordance with their provisions. Sodivone also reserves the right to immediately terminate these Terms, and/or your access to and use of our Services or any portion thereof, at any time and for any reason, with or without cause, including without limitation, if Sodivone believes, in its sole discretion, that you have violated or acted inconsistently with these Terms. Upon such termination, your right to use our Services shall immediately cease, whether made under these Terms or otherwise.

If your account is terminated, you’ll no longer have access to your account, including any of the associated data (though this does not limit or affect any rights you have under data or consumer protection laws). Where we terminate for a legitimate reason (e.g. where you have breached these Terms):

• you’ll not be entitled to any refunds and we’ll have no liability to you; and
• we also reserve the right to terminate any other accounts you may have created.

You understand and agree that using our Services comes with the risk that your account may be terminated or suspended in accordance with or without these Terms and that, whenever you use our Services, you’ll bear this risk in mind.

You agree to indemnify, defend and hold harmless, Sodivone, it affiliates, and their respective officers, directors, employees, agents, licensors, representatives, and third party providers to the Website from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from (a) your use of, or activities in connection with, the Website, or (b) any violation of these Terms by you. Sodivone reserves the right to assume, at its sole expense, the exclusive defence and control of any matter subject to indemnification by you, in which event you will fully cooperate with Sodivone in asserting any available defences.

Our Services may contain links to websites operated by other parties. We do not own or operate those other websites. We provide these links to you as a convenience, or other users might be posting these links as user-provided content. Use these links and the corresponding external websites at your own risk. We don’t control the linked sites, and we’re not responsible for the content available there. Such links don’t imply our endorsement of info or material on any other site, and we disclaim all liability with regard to your access to and use of such linked websites.

We may create updated versions of these Terms in the future as our Services and applicable laws evolve. When we do, we’ll inform you of the new agreement which will supersede and replace these Terms.

You’ll be given an opportunity to review any new agreement we present to you and decide whether you wish to agree to the revised terms. If you accept the new agreement, you’ll be able to continue using our Services. If you decline the new agreement, you won’t be able to use our Services anymore.

Sodivone may assign its rights under these Terms, in whole or in part, to any person or entity at any time with or without your consent. You may not assign your rights under these Terms without Sodivones’ prior written consent, and any unauthorized assignment by you shall be null and void.

You agree that no joint venture, partnership, employment, or agency relationship exists between you and Sodivone as a result of these Terms or your use of our Services.

Sodivones’ failure to enforce any provision of these Terms shall in no way be construed to be a present or future waiver of such provision, nor in any way affect the right of any party to enforce each and every such provision after that. Any waiver by Sodivone of any provision, condition or requirement of these Terms shall not constitute a waiver of any future obligation to comply with such provision, condition or requirement.

These Terms contain the entire agreement between you and Sodivone regarding the use of the Website and supersedes all prior understandings related to the Website. If any provision or portion of a provision of these Terms is held invalid, the remainder of this agreement and, if applicable, the affected provision shall continue in full force and effect.

YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS, AND THAT BY USING OR ACCESSING OUR SERVICES, YOU ARE AGREEING TO BE BOUND BY THE TERMS AND CONDITIONS SET OUT IN THESE TERMS. IF YOU DO NOT AGREE WITH ANY TERMS SET OUT IN OUR TERMS OF SERVICE AND OUR PRIVACY POLICY, PLEASE DO NOT USE OUR SERVICES.
